RE: INFORMATION AS PER ARTICLE 13, ITALIAN LAW 196 of 30/06/2003

Dear client / customer,
This is to inform you that Law no. 196/2003 (Italian Data Protection Act) provides for the protection of individuals and other subjects with regard to the processing of sensitive personal data.
In compliance with the principle of transparency, we hereby notify you that the processing of your personal data will be carried out in an adequate and right manner and at the highest possible level of security.

In conformity with art. 13 of the above mentioned law, we hereby provide you with the following information:

Nature
For the correct development of the contractual agreement, we need to process some data (considered as ‘common’ by the law) such as personal and fiscal data and obligatory keep them.

Purposes
The collection of your personal data will take place for the purposes of executing contracts, handling business negotiations, carrying out informative contacts, sending advertising material. With respect to the principle of necessity as per Art. 3, data shall be kept and treated for the whole period of the contract relationship and even later, within the limits necessary to fulfil law obligations and for administrative purposes.

Obligatory consent
Consenting to the processing of your data, from a strictly legal point of view, is voluntary. On the other hand, your refusal to provide the data shall make it impossible for us to execute or carry on the contractual relations. The collection of your data will take place by direct contact.

Manner
The processing will be carried out using a computer system with automated entry of the data in an internal database not accessible to the public, as well as entry in a protected paper database.

Communication and dissemination
Personal data shall not be disclosed or communicated to any other subject without requesting your express consent, except the communication to:

• public or private subjects who can have access to the database due to provisions of the law;
• public or private subjects whose activities are concerned or instrumental to the development of the contractual relation (i.e.: trading banks);
• subjects our consultants who will be appointed in charge or processors of the data treatment (i.e.: fiscal and legal consultants).

In any case your personal data shall be known by the offices and personnel in charge of our company.

Data subject’s rights:
You are entitled to contact the controller and the processors of the data with the means indicated above, to assert your rights, in the manner and under the terms set out in Section 7, Law 196/2003, the full text of which is given below:

1. A data subject shall have the right to obtian confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.
2. A data subject shall have the right to be informed:
   1. of the source of the personal data;
   2. of the purposes and methods of the processing;
   3. of the logic applied to the processing, if the latter is carried out with the help of electronic means;
   4. of the identification data concerning data controller, data processors and the representative designated as per Section 5 (2);
   5. of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
3. 3. A data subject shall have the right to obtain:
   1. updating, rectification or, where interested therein, integration of the data;
   2. erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
   3. certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected..
4. A data subject shall have the right to object, in whole or in part:
   1. on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
   2. to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys
